Legislation will accelerate permits for data center projects

Bipartisan legislation soon to be introduced in the state House of Representatives would ensure accelerated permits for data center projects that commit to equal, or higher, environmental performance.

The bill would direct the Pennsylvania Department of Environmental Protection to generate approved earthwork, stormwater and air permits to developers who commit to improved environmental outcomes by meeting, or exceeding, design standards. Air-permits, earthwork permits and stormwater approval would be granted when an application is paid. The process would enable developers to pursue simultaneously additional permits, land use approvals and other project approvals.

The bill also will state that if a lawsuit is filed challenging an aspect of a data center project, the associated permit timelines will be suspended during the legal dispute.

State Reps. Jamie Barton (R-Berks & Schuylkill), Kyle Mullens (D-Lackawanna) and Eric Nelson (R-Westmoreland) plan to introduce the bill.

“Faster permits can equal cleaner air and water,” Mullins said. “Simultaneous pursuit of much-needed parallel permitting welcomes investment and ensures responsible development. Our legislation grants air permits, earthwork permits and stormwater approval at the time of paid application and holds the generator accountable for meeting, or exceeding, federal air emissions and design standards.”

Skilled labor unions, economic development groups and Pennsylvania’s energy industry leaders endorse the legislation.
